This Agreement (“Agreement”) is made between Curated by Candy J (“Designer”) and the undersigned Client (“Client”) for the provision of digital design services and/or digital product delivery. By purchasing services, submitting payment, or engaging in communication for a project, the Client agrees to the following terms and conditions:
1. Payment Terms
1.1 All pricing is subject to change at any time and becomes effective immediately upon posting.
1.2 No services will begin until full payment has been received and cleared.
1.3 Quotes are valid for seven (7) days unless otherwise stated in writing.
2. Refunds & Cancellations
2.1 All payments are final and non-refundable.
2.2 No refunds will be issued for digital products, design services, or custom work after payment is submitted.
2.3 In the event the Designer is unable to complete the project for personal or unforeseen reasons, a full or partial refund may be issued at the Designer’s discretion.
3. Scope of Work
3.1 Project details will be agreed upon prior to commencement.
3.2 Any changes to the agreed-upon scope may result in additional fees and extended turnaround time.
4. Drafts & Intellectual Property
4.1 All preliminary drafts are the property of the Designer and are for approval purposes only.
4.2 Drafts may not be copied, altered, or distributed without the Designer’s written consent.
4.3 Final deliverables may be used by the Designer for marketing, promotional, and portfolio purposes unless otherwise stated in writing by the Client.
5. Revisions
5.1 Each design project includes up to three (3) revisions.
5.2 Additional revisions will incur a fee of $10 per revision.
5.3 Revision requests must be submitted clearly and promptly to avoid delays.
6. Design Vision & Quality Requirements
6.1 Clients are encouraged to have a clear vision before engaging services.
6.2 If the Client provides photos for use in the design, they must be:
High-quality and professional
Not pixelated, blurry, cut off, or screenshots
Solo images (unless otherwise agreed)
6.3 The Designer reserves the right to reject low-quality submissions that may impact final results.
7. Turnaround Time
7.1 Turnaround time begins once payment and all required materials are received.
7.2 Standard turnaround estimates are based on business days (Monday–Friday), excluding weekends and holidays.
7.3 During peak periods, timelines may extend by 1–3 business days.
7.4 The Designer is not responsible for delays caused by the Client, including but not limited to delayed communication or missing materials.
8. Delivery of Final Files
8.1 All final design files will be delivered via email.
8.2 Formats include:
Logos: JPG, PNG (transparent), PDF
Other graphics: JPG or PNG
8.3 It is the Client’s responsibility to trademark or copyright any completed work. The Designer is not responsible for legal registration.
9. Portfolio & Marketing Use
9.1 The Client grants Curated by Candy J permission to display completed work in digital portfolios, on social media, and in promotional materials.
9.2 If confidentiality is required, the Client must provide written notice before services begin.
10. Limitation of Liability
10.1 The Designer shall not be held liable for any loss, damage, or delay resulting from use or misuse of the final product.
10.2 Services are provided “as is,” without warranties or guarantees beyond those stated herein.
11. Modifications to Terms
11.1 These terms and conditions are subject to change at any time.
11.2 Continued use of services constitutes acceptance of the most current version.
By submitting payment or engaging services, the Client acknowledges that they have read, understood, and agreed to the above terms.
